CAREERACCELERATOR MOBILE APPLICATION PRIVACY POLICY

CareerAccelerator, Inc. has created the mobile application called CareerAccelerator. We will refer to CareerAccelerator, Inc. and CareerAccelerator in this Mobile Application Privacy Policy as “CareerAccelerator", “us,” “we”, and “our”. CareerAccelerator is committed to respecting the privacy rights of users (“you”). CareerAccelerator created this Mobile Application Privacy Policy (the “Policy”) to explain its information collection and use practices and the protection of your information when you download, install and use our mobile application, including Our software and documentation (collectively, the “App”). Any terms capitalized but not otherwise defined herein shall have the meanings set forth in the CareerAccelerator Mobile Application Use Agreement (“Use Agreement”).

We are committed to your data protection and data privacy. We recommend you read this Privacy Policy to better understand what information we collect, how we use it, and who we may share it with. Additionally, this Privacy Policy will provide you with details on how you can control the use and disclosure of your information.

By using Our App, our website located at https://careeraccelerator.squarespace.com/ (the “Website”) and any other linked pages, features, content, mobile applications, or any other services we offer from time to time by in connection therewith (collectively, the “Content and Services”), or by using the App, Website, Content and Services in any manner, you acknowledge that you accept the practices and policies outlined in this Policy, the Use Agreement , and you hereby consent that we will collect, use, and share your information in the following ways.

BY DOWNLOADING AND INSTALLING AND CREATING AN ACCOUNT, YOU (A) ACKNOWLEDGE THAT YOU HAVE READ AND UNDERSTAND THIS POLICY; (B) REPRESENT THAT YOU ARE 13 YEARS OF AGE OR OLDER; (C) THAT YOU ARE A RESIDENT AND CITIZEN OF THE UNITED STATES, AND (D) THAT YOU ACCEPT AND AGREE TO ABIDE BY THE TERMS IN THIS POLICY. IF YOU DO NOT AGREE TO THE TERMS IN THIS POLICY, DO NOT DOWNLOAD, INSTALL OR USE THE APP, AND DELETE IT FROM YOUR MOBILE DEVICE.

I. SERVICES

Our registered users (“Members”) share their professional identities, organize their professional contacts, enter and organize career information and goals, compare career prospects, and provide an enhanced and quantitative framework for potential opportunities. We use the term “Designated Countries” to collectively refer to countries in the European Union (EU), European Economic Area (EEA), and Switzerland and the term “Designated Country” to refer to a single country included in this region.

WHAT INFORMATION DOES CAREERACCELERATOR COLLECT?

We believe that it's important for you to know what types of information we collect when you use our App. CareerAccelerator collects the information set forth below. Therefore, by using the App, your information will be collected, stored and used in the manner described below. In many cases you choose what information to provide.

We only collect and process your information as permitted by applicable law. These lawful bases include where it is: necessary for the performance of a contract to which you are a party; necessary for us to take steps, at your request, to enter into such a contract; necessary for the purposes of our legitimate interests or those of a third party and not overridden by the interests or fundamental rights and freedoms of any data subject; where you provide us with consent; or necessary for compliance with a legal obligation to which we are subject. Under applicable law, we may be obliged to secure and maintain technical and organizational measures to protect the security of your data, investigate and report any (suspected) breaches of those technical and organizational measures, or comply with legal and regulatory obligations, including, but not limited to, complying with minimum retention periods for certain types of data.

IF YOU DO NOT AGREE TO THE COLLECTION AND USE OF YOUR INFORMATION IN THIS MANNER, DO NOT USE CAREERACCELERATOR OR THE APP. You may also opt out of the collection and use of your information using the opt out method set forth in this Policy. If you choose to opt out, the App may not function effectively.

A. Information Provided by You.
  1. Personal Information. When you download and create an account on our App (or if you create an account on our Website), you will be asked to provide to CareerAccelerator with certain information related to you (“Personal Information”). Personal Information includes: (a) "Contact Data" (personally identifiable information about you, such as your name, email address and mobile device number); (b) "Demographic Data" (personal information about you that doesn’t specifically identify you, such as Your gender, zip code, country, and lifestyle); and (c) "Usage Data" (information about your use of the App that doesn’t specifically identify you, such as your preferences and general use of the App). Additionally, we may receive Personal Information about contacts you associate with your profile in connection with your use of the App or the Website. Some jurisdictions also include images and photographs as Personal Information as well. You may have the option to upload a profile picture with your account.
  2. Non-Personal Profile Information. When you download and create an account on our App (or if you create an account on our Website), you may have the option to share additional information about your professional skills, desires, and goals, as well as your education and work experience. Do not include any information in your profile that you would not want to have publicly available.
  3. Other Information Shared by You. When you download and create an account on our App (or if you create an account on our Website), you may be asked to share additional information with CareerAccelerator in order to facilitate the provision of Content and Services and to secure your information, including payment (e.g., credit card) and billing information and a password. Like other mobile applications and services, our Content and Services may evolve. We may introduce new features, which may require or permit the collection of new information. If we collect materially different Personal Information or materially change how we collect, use or share your data, we will notify you and may also modify this Privacy Policy.
B. Information Made Available by You, Your Technologies, or Devices.
  1. Mobile Device and Service Use Data. When users download, install and use the App on a mobile phone or other wireless telecommunications device, CareerAccelerator automatically gathers information, including carrier providers, geo-location information (if allowed by you), the types of mobile devices accessing the App, and the types of operating systems accessing the App (collectively, "Mobile Device Data"). Location services can be enabled or disabled at any time through the mobile device settings. CareerAcceleator uses Mobile Device Data to understand usage patterns and to improve the App. Similarly, we log use data of our Website and App to monitor, among other things, useability and the security of our Content and Services. We use log-ins, cookies, device information and internet protocol (“IP”) addresses to identify you and log your use. Additionally, as described later in this Policy, we use cookies and similar technologies (e.g., pixels) to collect data (e.g., device IDs) to recognize you and your device(s) on, off and across different services and devices where you have engaged with our Content and Services. II. HOW DO WE USE COOKIES AND OTHER TRACKING TOOLS?

  • Strictly Necessary Cookies. Strictly necessary cookies facilitate the operation of our websites. Without the use of these cookies, portions of our websites would not function properly. For example, we use essential cookies to help us identify which of our visitors have previously registered in order to access our Premium Services.
  • Performance Cookies. Performance cookies help us monitor the performance of our websites and how users interact with them. These cookies collect information such as how often users visit our websites, what pages they visit when they do so, and what other websites they used prior to coming to our websites and provide us with information that allows us to improve our websites and services.
  • Functional Cookies. Functional cookies are used to remember your preferences on our websites and to authenticate your identity. For example, we use functional cookies to recognize and save your name and password on our websites.
  • Flash Cookies. When you use one of our websites that employs Macromedia Flash Player, a small Flash Cookie may be used. The purpose of using these cookies is to store your flash player preferences and enhance your browsing experience.

Although our websites currently do not respond to “do not track” browser headers, you can limit tracking through third-party programs and by taking the other steps discussed in this section. You may opt-out of CareerAccelerator’s use of certain cookies and similar Tracking Technologies by removing cookies or by setting your web browser and device settings to refuse cookies and similar Tracking Technologies. Please note that web browsers operate using different identifiers. As such, you must adjust your settings in each web browser and for each computer or device that you would like to opt-out on. Further, if you simply delete your cookies, you will need to remove cookies from your device after every visit to websites. You may block cookies entirely by disabling cookie use in your browser or by setting your browser to ask for your permission before setting a cookie. III. WHAT DO WE DO WITH THE INFORMATION THAT WE COLLECT?

We use, aggregate, and retain your Personal Information as needed to provide you with access to content, products, and services catered to your professional interests and for other legitimate business reasons. Some information is required in order to use our websites and for us to provide the Premium Services. At a high level, we use the Personal Information that has been provided by you directly or indirectly:

  • To provide you with our Content and Services including, access to our enhanced decision making and quantitative frameworks;
  • To create your member profile and purchase-intent history;
  • To send you satisfaction questionnaires, surveys, and information;
  • To tailor the Content and Services delivered to you based on your activity, interests, and responsibilities;
  • To communicate with you, advertise to you or invite you to join us on social media platforms on which you participate;
  • To operate our websites and improve our products and services;
  • To understand trends, usage statistics, and other data;
  • To respond to your product or service inquiries or support requests and comments;
  • To test and evaluate potential new products and features;
  • To assist with security, fraud prevention and investigations.
  • To diagnose and resolve problems, analyze trends, and monitor usage and resource needs; and
  • For any other purpose that we tell you about when you give us your Personal Information.

Our Content and Services provides you with a vehicle to assess your professional progress, job opportunities and prospects, and to determine the next steps in your career journey. The information that you provide is used to improve the content and usage of the App, interaction with the App, communicating with you about new features, and any other purpose for which the information was collected. We may also draw upon this information in order to adapt the App and Product to your needs, to research the effectiveness of these items, and to develop new features. We may use automated systems to provide content and recommendations to help make our Content and Services more relevant to our Members, thus, it is recommended that Members regularly review and maintain their information within the App and our Website.

IV. WHO DOES CAREERACCELERATOR SHARE YOUR DATA WITH?

CareerAccelerator may share information with service providers, affiliates, partners (such as professional career coaches and other third parties engaged to further the intent of the Website and App in line with the information set forth herein), and other third parties where it is necessary to meet the requirements of our Use Agreement, to provide the Content and Services, or for any other purposes described in this Policy.

  • Partners. CareerAccelerator may provide or make available to partners with select information that may include your Personal Information derived from your activity on our Website and App and interaction with content. They may also use this information to contact you about products or services that are relevant to your professional interests. For example, providing you with professional opportunities or mentorship. CareerAccelerator’s contractual arrangements with its partners, when subject to our standard terms and conditions, require, among other things, that our partners (a) only use this information to contact you via email, telephone, mail or other means of communication for internal sales and marketing purposes; and (b) secure and protect your information in accordance with applicable law and our instructions. If you do not want this information shared, please see “Your Privacy Rights and Controlling Your Personal Information” below.
  • Vendors and Service Providers. CareerAccelerator may provide your Personal Information to certain vendors and service providers who are working for or with CareerAccelerator as described in this Policy and who require access to such information to facilitate the provision of our services, such as the provision of processing activities or corporate auditing services. CareerAccelerator will always attempt to limit the information that we provide to what is reasonably sufficient for those vendors or service providers to carry out their responsibilities as they relate to the fulfillment of our Content and Services.
  • Third-Party Analytics. We allow our third-party analytics partners to collect certain information on our websites, as described earlier herein.
  • Business Transfers, Affiliates, and Subsidiaries. We may share or transfer the information that we collect in connection with, or during negotiations of, any merger, sale of company assets, financing, or acquisition of all or a portion of our business to another company. We may share your Personal Information within our organization, including with our affiliates and subsidiaries, in order to facilitate the provision of services in connection with your use of our websites or your membership to our network of websites.
  • Vital Interests. We may disclose the information that we collect where we believe that it is necessary in order to protect the vital interests of any person, or to exercise, establish, or defend our legal rights.
  • Other ways in which you specifically consent. We may share the information that we collect in other ways that you specifically consent.
  • Legal Compliance and Public Safety. We may share your Personal Information when required by law, subpoena, or other legal process or if we have a good faith belief that disclosure is reasonably necessary to (a) investigate, prevent, or take action regarding suspected or actual illegal activities or to assist government enforcement agencies; (b) enforce our agreements, (c) investigate and defend ourselves against any third-party claims or allegations, (d) protect the security or integrity of our services; or (e) exercise or protect the rights and safety of our members, personnel, or others. We may attempt to notify members about legal demands for their Personal Information when appropriate in our judgment, unless prohibited by law or court order or when the request is an emergency. We may dispute such demands when we believe, in our discretion, that the requests are overbroad, vague or lack proper authority, but we do not promise to challenge every demand.

V. EMAIL AND TEXT COMMUNICATIONS

By using the App, you may receive periodic email and text communications from CareerAccelerator, such as new feature notifications and other information. You may also receive in App communications from CareerAccelerator. You can opt-out of receiving certain types of emails and messages at any time by following the unsubscribe instructions contained in each message; however, you may continue to receive legally required notices and messages, provided that you continue to be a Member or to use our Content and Services.

VI. DATA RETENTION

We retain your information as necessary to comply with our legal obligations, resolve disputes, and enforce our agreements. We will retain Members’ Personal Information for so long as a Member’s account remains in existence or as needed to provide our Content and Services to our Members, to comply with our legal obligations, to resolve disputes, and to enforce our agreements. We may retain Personal Information after a Member has cancelled their membership if retention is reasonably necessary to comply with our legal obligations, meet regulatory requirements, resolve disputes, prevent fraud and abuse, or enforce this Policy and our Use Agreement. We may also retain Personal Information, for a limited period, if requested by law enforcement.

VII. DATA SECURITY

The security of your Personal Information is extremely important to us. CareerAccelerator has implemented and maintains reasonable security procedures and practices designed to protect against the unauthorized access, use, modification, destruction or disclosure of your personal information, however, despite these efforts, no security measures are perfect or impenetrable and no method of data transmission can be guaranteed against any interception or other type of misuse. Both CareerAccelerator and users of the App must do their part to ensure the security of data. You should ensure that any Personal Information shared with us is done by way of your CareerAccelerator personal account. Additionally, you should secure your account by protecting it with a strong password. You should not disclose your password to anyone.

If you have reason to believe that the Personal Information that we hold about you, such as your account with the App, other program profile(s), or other membership information is no longer secure, please notify us of the problem by emailing us via the feedback function in the app or writing to our physical address in the “Contact Us/Opt Out” section below.

VIII. THIRD PARTY WEBSITES

The App may contain links to other sites. CareerAccelerator does not own or control the content or links that appear on these sites and is not be responsible for the privacy and security practices employed by websites linked to, or from our App. This Policy does not apply to any such third party apps. The third parties to whom we may provide this information may include commercial partners, sponsors, licensees, researchers and other similar parties. Before visiting or providing Personal Information to a third party App, you should inform yourself of the privacy policies and practices (if any) of that third party app, and should take those steps necessary to, in Your discretion, protect your privacy.

IX. CHILDREN'S PRIVACY

We do not seek or knowingly collect any Personal Information about children under 13 years of age. If we become aware that we have unknowingly collected Personal Information from a child under the age of 13, we will make commercially reasonable efforts to delete such information from our database. If you are under the age of 13, please do not submit any Personal Information through our App, and rely on a parent or guardian to help you use our App. If CareerAccelerator obtains actual knowledge that it has collected Personal Information from a child under the age of 13, CareerAccelerator will promptly delete such information from its database. If you believe that we might have any information from or about a child under 13, please contact us via the feedback function in the app.

X. COPYRIGHT AND TRADEMARK NOTICE

The App, the Website, the Content and Services are the exclusive property of CareerAccelerator, and may not be copied, distributed, displayed, altered or modified, or reproduced or transmitted, in any form or by any means including, but not limited to, electronic, photocopy, or otherwise, without the prior written permission of CareerAccelerator. The corporate and product names, slogans, logos and other content contained on this site are the registered or unregistered trademarks or service marks of CareerAccelerator or are used by the App with the permission of their owners. The use, copying or alteration of any trademark without the express prior written consent of CareerAccelerator or, where applicable, the registered owner's express prior written consent is strictly prohibited. The trademarks are protected under the Trademark Act and by state or common law.

XI. WARRANTY DISCLAIMER AND LIMITATION OF LIABILITY

THE APP IS PROVIDED TO YOU “AS IS” AND WITH ALL FAULTS AND DEFECTS AND WITHOUT WARRANTY OF ANY KIND. TO THE MAXIMUM EXTENT PERMITTED UNDER APPLICABLE LAW, CAREERACCELERATOR (ON ITS OWN BEHALF AND ON BEHALF OF ITS AFFILIATES) EXPRESSLY DISCLAIMS ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, WITH RESPECT TO THE APP, INCLUDING ALL IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT, AND WARRANTIES THAT MAY ARISE OUT OF COURSE OF DEALING, COURSE OF PERFORMANCE, USAGE, OR TRADE PRACTICE. WITHOUT LIMITATION TO THE FOREGOING, WE PROVIDE NO WARRANTY OR UNDERTAKING, AND MAKE NO REPRESENTATION OF ANY KIND THAT THE APP WILL MEET YOUR REQUIREMENTS, ACHIEVE ANY INTENDED RESULTS, BE COMPATIBLE, BE ACCURATE, COMPLETE OR RELIABLE, OR WORK WITH ANY OTHER SOFTWARE, APPLICATIONS, SYSTEMS, OR SERVICES, OPERATE WITHOUT INTERRUPTION, MEET ANY PERFORMANCE OR RELIABILITY STANDARDS OR BE ERROR-FREE, OR THAT ANY ERRORS OR DEFECTS CAN OR WILL BE CORRECTED.

SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF OR LIMITATIONS ON IMPLIED WARRANTIES OR THE LIMITATIONS ON THE APPLICABLE STATUTORY RIGHTS OF A CONSUMER, SO SOME OR ALL OF THE ABOVE EXCLUSIONS AND LIMITATIONS MAY NOT APPLY TO YOU.

(a) PERSONAL INJURY, PROPERTY DAMAGE, LOST PROFITS, COST OF SUBSTITUTE GOODS OR SERVICES, LOSS OF DATA, LOSS OF GOODWILL, BUSINESS INTERRUPTION, COMPUTER FAILURE OR MALFUNCTION, OR ANY OTHER CONSEQUENTIAL, INCIDENTAL, INDIRECT, EXEMPLARY, SPECIAL, OR PUNITIVE DAMAGES; AND (b) DIRECT DAMAGES IN AMOUNTS THAT IN THE AGGREGATE EXCEED THE AMOUNT ACTUALLY PAID BY YOU FOR THE APPLICATION.

THE FOREGOING LIMITATIONS WILL APPLY WHETHER SUCH DAMAGES ARISE OUT OF BREACH OF CONTRACT, TORT (INCLUDING NEGLIGENCE), OR OTHERWISE AND REGARDLESS OF WHETHER SUCH DAMAGES WERE FORESEEABLE OR WE WERE ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS OF LIABILITY SO SOME OR ALL OF THE ABOVE LIMITATIONS OF LIABILITY MAY NOT APPLY TO YOU.

XII. INDEMNITY

You hereby indemnify CareerAccelerator and its affiliates from and against any losses, damages, costs, liabilities and expenses (including without limitation legal expenses and any amounts paid by CareerAccelerator or its affiliates to a third party in settlement of a claim or dispute) incurred or suffered by CareerAccelerator arising out of any breach by you of any provision of this policy or arising out of any claim that you have breached any provision of this Policy.

XIII. INTERNATIONAL USERS

If you are located outside the United States or in a Designated Country and choose to provide your information to CareerAccelerator, your information (including your Personal Information) will be transferred to and processed in the United States or any other country in which CareerAccelerator operates. By providing your information to or making your information available to CareerAccelerator and using the App, you agree and consent to the collection, transfer, use, storage and disclosure of your information as described in this Policy. If you are located in a Designated Country, or other country with similar privacy laws, you should be aware that this Policy does not accord with applicable EEA laws regarding your Personal Information. If you are located in a Designated Country or other country with similar privacy laws, you should not download or use the App and you should not provide us with any of your information. IF YOU DO NOT CONSENT TO THE COLLECTION, TRANSFER, USE, STORAGE AND DISCLOSURE OF YOUR INFORMATION AS DESCRIBED IN THIS POLICY, DO NOT USE THIS APP.

XIV. Your Privacy Rights and Controlling Your Personal Information

If you would like CareerAccelerator to delete your Personal Information from its system, please contact us at the address included in the “Contact Us/Opt Out” section below or via the feedback function in the app with a request that we delete your Personal Information from our database. We will use commercially reasonable efforts to honor your request; however, we may retain an archived copy of your records as required by law or for other legitimate business purposes.

CareerAccelerator wants your Personal Information to be complete and accurate. By using the App, you represent and warrant that all information you provide in connection with your use of the App, Content and Services will be complete and accurate, and that you will update that information within the App and Website as necessary or able to maintain its completeness and accuracy.

Residents and citizens of certain regions may be afforded additional rights and disclosures. With that being said, currently, the App and Website are only available for use by United States residents and citizens and is only in compliance with United States law. CareerAccelerator is not seeking, targeting, or directing business to individuals who are not United States residents or and citizens. XV. REVISIONS AND MODIFICATIONS TO THIS POLICY

We may modify or amend this Policy from time to time. If we change our Policy, we will post those changes in addition to updating the “Last Updated” date at the top of this Policy. We encourage you to read this Policy regularly. Where applicable, your continued use of our App, Website, or accessing our Content and Services shall constitute your acceptance of the modified or amended Policy. If there will be any changes made to the use of your Personal Information in a manner materially different from that stated at the time of collection, we will notify you by posting a notice on our website.

XVI. ACCEPTANCE OF POLICY

By using our App, you signify your acceptance of this Policy. If you do not agree to this Policy, please do not download, install or use our App.

CAREERACCELERATOR CALIFORNIA PRIVACY NOTICE

This CareerAccelerator California Privacy Notice (“Notice”) describes the rights of Californians under the California Consumer Privacy Act of 2018 (“CCPA”). The CCPA requires businesses like us that receive information from more than fifty thousand California consumers to provide certain information to them. We fully describe our practices to all our members and visitors in our Mobile Application Privacy Policy, but use this separate notice to ensure that we meet the CCPA’s requirements. Capitalized terms not otherwise defined herein shall have the meanings attributed to them in our Mobile Application Privacy Policy.

I. We Do Not Sell Your Personal Information

The CCPA requires us to disclose whether we sell your personal information. We do not sell your personal information.

II. Your Rights Under The CCPA

The CCPA provides Californians with the following rights:
Requests for Information: You (or your authorized agent) can request a copy of your Personal Information.   • Security Purposes: In order to secure our Content and Services, including to detect, prevent, and investigate security incidents or violations of our Use Agreement or applicable laws, we may share the types of Personal Information listed above.
  • Service Improvements: In order to improve our Content and Services (such as to identify bugs, repair errors, or ensure that services function as intended) or conduct internal research and analysis to improve our technology, we may share the types of personal information identified above with our partners, service providers, and related companies.
  • Service Providers and Other Notified Purposes: We may share the types of Personal Information listed above with Service Providers, as defined by the CCPA, in order to have them perform services specified by a written contract or with others for a notified purpose permitted by the CCPA (e.g., to respond to law enforcement requests).
